1. Acceptance of Terms
By accessing or using MyPestPal™ (the “Service”), you agree to be bound by these Legal Use Terms & Conditions ("Terms") with MyPestPal™, a licensed business and the legal entity operating the Service. If you do not agree to these Terms, do not access or use the Service. You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the Service; users under 18 must have parental or guardian consent.
2. Informational Use Only — No Professional Advice
MyPestPal provides educational information about pests, including AI-generated identifications, biology, behaviour and suggested control methods. The Service is not a substitute for professional pest-control, medical, veterinary, agricultural, environmental or legal advice. Pesticide use is regulated by federal, state, and local law (including the U.S. EPA FIFRA framework and state agriculture departments); you are solely responsible for reading and following product labels and applicable regulations. Always consult a licensed professional for severe infestations, allergic reactions, disease exposure, protected species, or before applying any pesticide.
3. Accounts & Security
Some features require an account. You agree to provide accurate information, keep credentials confidential, and are responsible for all activity under your account. Notify us immediately of any unauthorised use. We may refuse registration or terminate accounts at our discretion.
4. Acceptable Use
You agree not to: (a) reverse-engineer, decompile, or copy the Service or its code; (b) scrape, crawl, or bulk-extract data; (c) use the Service to train machine-learning or generative-AI models; (d) attempt to bypass security, rate limits, or paywalls; (e) upload unlawful, infringing, harassing, or harmful content; (f) impersonate others or misrepresent affiliation; (g) use the Service to violate any applicable law, regulation, or third-party right. You are solely responsible for any content you submit.
5. Payments, Subscriptions & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. MyPestPal Pro is billed monthly or yearly and renews automatically until cancelled. 6. AI-Generated Content
MyPestPal uses AI models to generate pest identifications and related information. Outputs may be inaccurate or incomplete and are not suitable as professional advice. You are responsible for verifying accuracy and for having the rights to any image or content you upload. You must not use the Service to generate unlawful content, harass others, or attempt to jailbreak the underlying models. We may filter, remove, or refuse outputs and suspend accounts that repeatedly violate these terms.
7. Suspension & Termination
We may suspend or terminate your access, with or without notice, for material breach of these Terms, non-payment, suspected fraud, security risk, or repeated policy violations. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification and dispute resolution) will survive.
8. Intellectual Property & DMCA
All content, design, code, text, graphics and the "MyPestPal" name and logo are the property of MyPestPal and protected by copyright and trademark law. See the Copyright & IP page for the full notice, licence terms for user-submitted content, and DMCA takedown procedure under 17 U.S.C. § 512.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF PEST IDENTIFICATIONS, OR UNINTERRUPTED OPERATION. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYPESTPAL™ AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY RELIANCE ON AI-GENERATED IDENTIFICATIONS OR PEST-CONTROL SUGGESTIONS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (a) AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (b) USD $50.
11. Indemnification
You agree to defend, indemnify, and hold harmless MyPestPal™ and its affiliates from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States and the State in which MyPestPal™ is domiciled, without regard to conflict-of-laws principles. Except where prohibited, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered under the rules of a recognised arbitration provider, and not by class action. You may opt out of arbitration within 30 days of first accepting these Terms by contacting us. Small-claims court actions and requests for injunctive relief for IP infringement are excluded from arbitration.
13. Export, Sanctions & Compliance
You may not use the Service in violation of U.S. export controls or sanctions, and you represent you are not located in an embargoed country or on a restricted-party list.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be indicated by updating the "Last updated" date above.
15. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Notice, Refund Policy, Cookie Policy, and Copyright & IP notice, constitute the entire agreement between you and MyPestPal™ regarding the Service.
